Specifications

A complaint or indictment may include a specification which adds a mandatory amount of prison time to the maximum prison term for the offense. This simply means that even if you get the minimum amount of time for the underlying offense, the time given under the specification is mandatory and not subject to the judge's discretion.

There are many different specifications, which to be found guilty, must be set forth in the complaint or indictment.

Some examples include:

  1. R.C. 2941.141 -- One year firearm specification.

  2. R.C. 2941.144 --Six year firearm specification.

  3. R.C. 2941.145 --Three years firearm specification.

  4. R.C. 2941.146 -- Drive by specification.

  5. R.C. 2941.147 -- Sexual motivation specification.

  6. R.C. 2941.148 -- Sexually violent predator specification.
