What is an administrative driver's license suspension? 

Under R.C. 4511.191, if a person has been stopped for suspected OVI and refuses chemical testing of the blood, urine or breath, they will be subjected to an immediate driver’s license suspension.

FIRST TIME REFUSAL OR TESTING OVER THE LEGAL LIMIT OF .08:

  • The Ohio bureau of motor vehicles "BMV" will impose a class C driver’s license suspension, which requires a mandatory suspension of 1 year.

 

SECOND REFUSAL WITHIN THE PAST 6 YEARS OF A PRIOR OVI CONVICTION:

  • The Ohio bureau of motor vehicles "BMV" will impose a class B driver’s license suspension, which is for two years.

THIRD REFUSAL WITHIN THE PAST 6 YEARS WITH EITHER TWO PRIOR OVI CONVICTIONS OR ONE CONVICTION AND ONE REFUSAL TO TEST

  • The Ohio bureau of motor vehicles "BMV" will impose a class  A driver’s license suspension, which is for a mandatory three years.

FOURTH REFUSAL WITHIN THE PAST 6 YEARS WITH EITHER THREE OR MORE PRIOR OVI CONVICTIONS OR REFUSAL TO TEST 

  • The Ohio bureau of motor vehicles "BMV" will impose a five year driver’s license suspension.
